FixWeb is a website-quality scanning service operated by EGO HERO LLC (“FixWeb”, “we”, “us”, “our”). By creating an account, signing in, or running an anonymous scan, you (“you”, “Customer”) agree to these Terms, our Acceptable Use Policy, our Disclaimer, and our Privacy Policy. If you do not agree to all of the foregoing, do not use FixWeb.

FixWeb ব্যবহার করতে আপনার বয়স কমপক্ষে ১৬ বছর হতে হবে। আপনি যদি কোনো প্রতিষ্ঠানের পক্ষে FixWeb ব্যবহার করেন, তবে আপনি ঘোষণা ও নিশ্চয়তা দিচ্ছেন যে সেই প্রতিষ্ঠানকে এই শর্তাবলীতে আবদ্ধ করার ক্ষমতা আপনার আছে।

Before applying any suggested remediation — whether by hand or by passing it to an AI coding tool — you must independently review it, test it in a non-production environment where appropriate, and confirm that it is correct, complete, and appropriate for your system. Active checks আপনার application-এ crafted payloads পাঠায়। বিরল ক্ষেত্রে এই payloads অপ্রত্যাশিত আচরণ ঘটাতে পারে, যার মধ্যে slow responses, error spikes, partial outages, অথবা production stores-এ test data লেখা অন্তর্ভুক্ত। একটি active scan চালিয়ে আপনি এই risks স্বীকার ও গ্রহণ করছেন। সম্ভব হলে staging environments-এর বিরুদ্ধে active scans চালানোর পরামর্শ দিই।

আপনি আমাদের যে system পরীক্ষা করার অনুমতি দিয়েছেন, তার বিরুদ্ধে active scan চালানোর ফলে revenue, data, customers, বা goodwill-এর কোনো loss হলে FixWeb দায়ী নয়।

নির্ধারিত re-scans. আপনি verified domain-এ recurring schedule enabled করলে (শুধু Pro / Unlimited), প্রতিটি cron-triggered scan সেই authorization-to-scan attestation inherit করে যা আপনি প্রথম domain ownership verify করে scan শুরু করার সময় দিয়েছিলেন। Schedule enabled থাকা পর্যন্ত attestation বহাল থাকে। আপনি যে কোনো সময় ড্যাশবোর্ড → ডোমেইন-এ schedule disable করে revoke করতে পারেন; পরবর্তী cron tick domain skip করবে।

Paid plans Stripe-এর মাধ্যমে monthly বা annually billed হয়। Renewal date-এর আগে cancel না করলে subscriptions automatically renew হয়। আপনি যে কোনো সময় অ্যাকাউন্ট → বিলিং থেকে cancel করতে পারেন; আপনি যে period-এর জন্য paid করেছেন, তার শেষ পর্যন্ত access চলবে।

Mandatory consumer-protection law যেখানে required করে তা ছাড়া fees non-refundable। EU এবং UK consumers স্বীকার করেন যে FixWeb একটি digital service যা scan submission-এর সঙ্গে সঙ্গেই benefits প্রদান শুরু করে, এবং scan চালিয়ে বা paid features ব্যবহার শুরু করে তারা cooling-off period-এর মধ্যে service performance শুরু করার express request করছেন এবং EU Directive 2011/83/EU Article 16(m)-এর অধীনে withdraw করার অধিকার waive করছেন। সন্দেহ এড়াতে, আমরা আমাদের sole discretion-এ goodwill refunds offer করতে পারি।

Pricing, plan limits, এবং feature availability পরিবর্তিত হতে পারে। Active paid plans-কে প্রভাবিত করে এমন material changes কমপক্ষে ৩০ দিন আগে announced হবে।

আপনি FixWeb-এ জমা দেওয়া যে কোনো data (“Customer Data”)-এর সব rights ধরে রাখেন, যার মধ্যে scan targets, request payloads, response captures, evidence blobs, এবং আপনার দেওয়া যে কোনো text অন্তর্ভুক্ত। আপনি EGO HERO LLC-কে Customer Data host, process, transmit, এবং display করার একটি limited, worldwide, non-exclusive, royalty-free license দেন, শুধু আপনার জন্য FixWeb operate করতে এবং service maintain, troubleshoot, ও improve করতে যতটা প্রয়োজন ততটাই। আমরা Customer Data third-party AI models train করতে ব্যবহার করি না।

GitHub-integrated scans. আপনি optional GitHub integration connect করলে (Pro এবং Unlimited plans) এবং repo scan চালালে, আমরা আপনার stored OAuth token ব্যবহার করে GitHub REST API-এর মাধ্যমে repository content fetch করি। Source content findings তৈরি করতে memory-তে process হয়; শুধু আমরা যে individual finding evidence surface করি সেটি persist হয়, এবং ordinary scans-এর একই retention window-এর জন্যই। আমরা কখনও full source dumps long-term storage-এ লিখি না এবং repository content কখনও AI models train করতে ব্যবহার করি না। পূর্ণ বিবরণের জন্য গোপনীয়তা নীতি দেখুন।

আমরা high availability লক্ষ্য করি, কিন্তু আলাদা written service-level agreement না থাকলে কোনো uptime guarantee দিই না। Hobby-tier features notice ছাড়াই পরিবর্তিত বা discontinued হতে পারে। Paid features কমপক্ষে ৩০ দিন notice ছাড়া discontinued হবে না।

FIXWEB “যেমন আছে” এবং “যতটুকু উপলভ্য” ভিত্তিতে প্রদান করা হয়, কোনো ধরনের express বা implied warranty ছাড়া, যার মধ্যে merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, অথবা service uninterrupted, secure, বা error-free হবে এমন implied warranties অন্তর্ভুক্ত কিন্তু তাতেই সীমাবদ্ধ নয়।

We do not warrant that FixWeb will detect every website-quality issue in your application. We do not warrant that any finding is accurate, material, or relevant to your environment. We do not warrant that any suggested remediation, including any AI-generated text, is correct, safe to apply, or appropriate for your use case. The absence of a finding is not, and must not be relied upon as, evidence that your website is complete, compliant, accessible, performant, or secure.

কিছু jurisdictions নির্দিষ্ট warranties exclude করতে দেয় না; সেই jurisdictions-এ উপরোক্ত exclusions কেবল law যতটা maximum extent অনুমতি দেয় ততটাই apply হবে।

APPLICABLE LAW যতটা MAXIMUM EXTENT অনুমতি দেয়, EGO HERO LLC এবং তার affiliates, officers, directors, employees, agents, ও licensors কোনো indirect, incidental, special, consequential, exemplary, বা punitive damages, অথবা profits, revenue, data, business, goodwill, বা anticipated savings-এর loss-এর জন্য liable হবে না, যা আপনার FIXWEB use বা inability to use থেকে arising out of বা related, এমনকি আমরা এমন damages-এর possibility সম্পর্কে advised হলেও।

• কোনো applicable law বা third-party right আপনার violation।

আপনি represent করছেন যে আপনি এমন ব্যক্তি বা entity নন, এবং তাদের পক্ষে act করছেন না, যে (a) comprehensive U.S. বা EU sanctions-এর অধীন কোনো country বা region-এ ordinarily resident (currently including Cuba, Iran, North Korea, Syria, এবং Ukraine-এর Crimea, DNR, ও LNR regions); (b) কোনো U.S. Treasury OFAC Specially Designated Nationals list, U.S. Commerce Department denied-persons list, EU consolidated financial sanctions list, বা U.K. HMT consolidated list-এ listed; অথবা (c) applicable export-control laws-এর অধীনে U.S. company থেকে software বা services receive করতে otherwise prohibited। আপনি FixWeb এমন কোনো activity facilitate করতে ব্যবহার করবেন না যা ওই laws violate করে।

আমরা যে কোনো সময়, notice সহ বা ছাড়া, আপনার FixWeb access suspend বা terminate করতে পারি, যদি আমরা reasonably believe করি যে আপনি এই Terms, Acceptable Use Policy, বা applicable law violate করেছেন, অথবা service-এর continued provision আমাদের legal বা operational risk-এ ফেলবে। আপনি যে কোনো সময় অ্যাকাউন্ট → গোপনীয়তা থেকে আপনার account delete করে terminate করতে পারেন। Sections 4, 5, 7, 9, 10, 11, 12, 14, 15, 16, 17, 18, এবং 20 termination-এর পর survive করবে।

কোনো party তার reasonable control-এর বাইরে events-এর কারণে performance failure বা delay-এর জন্য liable নয়, যার মধ্যে acts of God, war, terrorism, civil unrest, governmental action, pandemic, labor disputes, internet বা telecommunications outages, অথবা upstream service providers-এর failures (including but not limited to Vercel, Supabase, Stripe, এবং Cloudflare) অন্তর্ভুক্ত।

এই Terms, এবং এগুলি বা FixWeb থেকে arising out of বা related যে কোনো dispute, State of Wyoming, USA (EGO HERO LLC-এর state of registration)-এর laws দ্বারা governed, conflict-of-laws principles বিবেচনা না করে। U.N. Convention on Contracts for the International Sale of Goods apply করে না।

আপনি যদি United States-এর resident হন, আপনি এবং EGO HERO LLC agree করেন যে এই Terms বা FixWeb থেকে arising out of বা relating যে কোনো dispute, claim, বা controversy (প্রতিটি “Dispute”) American Arbitration Association (“AAA”) দ্বারা তার Consumer Arbitration Rules-এর অধীনে administered binding individual arbitration-এ resolved হবে। Arbitration English language-এ, amount in controversy USD 25,000-এর কম হলে documents-only basis-এ (অন্যথায় remotely), এবং seated in Cheyenne, Wyoming হবে। Award-এর judgment competent jurisdiction-এর যে কোনো court-এ entered হতে পারে।

CLASS ACTION WAIVER। আপনি এবং EGO HERO LLC agree করেন যে প্রত্যেকে অন্যজনের বিরুদ্ধে claims আনতে পারবেন শুধু individual capacity-তে, কোনো purported class, collective, বা representative proceeding-এ plaintiff বা class member হিসেবে নয়। Arbitrator একাধিক ব্যক্তির claims consolidate করতে পারবেন না এবং কোনো representative বা class proceeding-এর কোনো form preside করতে পারবেন না।

৩০ দিনের opt-out. আপনি এই Terms প্রথম accept করার ৩০ দিনের মধ্যে support@fixweb.app-এ written notice পাঠিয়ে এই arbitration agreement এবং class waiver থেকে opt out করতে পারেন। আপনার notice-এ আপনার name, account email, এবং আপনি arbitration থেকে opt out করছেন তা state করতে হবে। Opting out এই Terms-এর অন্য কোনো provision affect করে না।

যে কোনো party সেই court-এর jurisdiction-এর মধ্যে থাকা disputes-এর জন্য small-claims court-এ individual action আনতে পারে, এবং intellectual property infringement বা FixWeb-এ unauthorized access-এর জন্য court-এ injunctive বা other equitable relief seek করতে পারে।

এই Section 16-এর কোনো portion unenforceable held হলে, remainder maximum extent permitted পর্যন্ত enforced হবে; class action waiver itself unenforceable held হলে, affected dispute-এর জন্য সম্পূর্ণ arbitration agreement void হবে এবং litigation Section 15-এ identified courts-এ proceed করবে।

European Union, United Kingdom, অথবা এমন কোনো jurisdiction যেখানে mandatory law তাদের home courts-এ claims আনবার অধিকার দেয়, সেখানে ordinarily resident consumers সেই অধিকার retain করেন। Section 16-এর arbitration agreement এবং class action waiver এমন consumers-এর ক্ষেত্রে mandatory local consumer protections-এর সঙ্গে conflict করার extent-এ apply করে না।

Scan reports may identify a third-party hostname and assert that it has website-quality issues. Because our findings are heuristic and may include false positives, you agree that you will not publicly post, share on social media, or otherwise make available to the general public any FixWeb scan report or screenshot that identifies a target hostname you do not own or operate, without first obtaining the target operator's written consent.

এই restriction (i) affected operator-কে responsible disclosure, (ii) আপনার মালিকানাধীন বা operated systems-এর reports share করা, অথবা (iii) target identify করে না এমন redacted summaries share করা prohibit করে না।

আমরা সময়ে সময়ে এই Terms revise করতে পারি। Material changes কার্যকর হওয়ার কমপক্ষে ১৪ দিন আগে in-app বা email দ্বারা announced হবে। Effective date-এর পরে FixWeb continued use revised Terms-এর acceptance গঠন করে। Current version এবং effective date এই page-এর উপরে দেখানো হয়।

এই Terms, গ্রহণযোগ্য ব্যবহার নীতি, দায় অস্বীকার, এবং গোপনীয়তা নীতি সহ, FixWeb সম্পর্কে আপনার এবং EGO HERO LLC-এর মধ্যে entire agreement গঠন করে এবং একই subject-এর ওপর prior বা contemporaneous agreements supersede করে। কোনো provision unenforceable held হলে, remaining provisions full force and effect-এ থাকে। কোনো right enforce করতে আমাদের failure সেই right-এর waiver নয়। আমাদের written consent ছাড়া আপনি এই Terms assign করতে পারবেন না; আমরা sale, merger, বা reorganization-এর সঙ্গে connection-এ assign করতে পারি। কোনো third-party beneficiaries নেই।
